FOREST MASTER LTD appreciates your interest in the company and its products. We request and strongly encourage you to carefully read these Terms of use before using the Site. By using the Site you agree to be bound by the Terms.
General
This website and any sub-sites thereof, (together with the “Site”) is published and maintained by FOREST MASTER. Your use of the Site is subject to a legally binding agreement between you and FOREST MASTER (the “Agreement”). The following are the terms of the Agreement (the “Terms”). By using the Site you acknowledge that you have read, understood and agreed to the Terms and all related documents. It is important that you read them carefully. If you do not agree to the Terms and all related documents, you are not allowed to use the Site.
License
Subject to the Terms set forth in this Agreement, FOREST MASTER grants you a non-exclusive, non-transferable, limited right to access, use and display this Site and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the Site in any way. FOREST MASTER authorizes you to view and download the information (“Materials”) on the Site only for your personal, non-commercial use, unless otherwise expressly stated in the FOREST MASTER Newsroom. This authorization is not a transfer of title in the Materials and copies of the Materials and is subject to the following restrictions: 1) you must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials; 2) you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use or communicate them for any public or commercial purpose; and 3) you must not transfer the Materials to any other person unless you give them notice of, and they agree to accept, the obligations arising under these Terms. You agree to abide by all additional restrictions displayed on the Site as they may be updated from time to time.
User Warranties
You represent and warrant that you will use the Site in compliance with these Terms including the laws and provisions under this Agreement and to comply with all existing and future Site policies and rules. You agree that you will not use the Site to (a) transmit spam or unsolicited communications; (b) pretend to be FOREST MASTER or someone else or allow a third party to pretend to be you; (c) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Site; (d) misrepresent your affiliation with a person or entity; (e) act in a manner that negatively affects other users’ ability to use the Site; (f) engage in activities that would violate any applicable law, (g) post or transmit any material which violates or infringes in any way upon the rights of others or which is unlawful, abusive, defamatory, vulgar or otherwise objectionable or which contains any advertising or solicitation with respect to products or services or (h) collect or store personal data about other users unless specifically authorized by such users.
Privacy
Information about FOREST MASTER’s privacy practices and collection and treatment of personal information can be found in FOREST MASTER’s Privacy Policy. You agree to your data and personal information being used in accordance with FOREST MASTER’s Privacy Policy.
Changes
FOREST MASTER reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement in whole or in part, at any time and without giving prior notice. Changes in this Agreement will be effective when posted on the Site. Your continued use of the Site after any change to this Agreement is posted will be considered acceptance of those changes.
Intellectual Property Rights
You acknowledge and agree that all intellectual property rights (including, but not limited to, copyright, patents, know-how, confidential information, database rights, and rights in trademarks and designs whether registered or unregistered) in the Site are vested in FOREST MASTER or its licensors. All goodwill and intellectual property rights arising through the use of such intellectual property rights vested in FOREST MASTER shall inure to FOREST MASTER. This Site, including all Materials, is copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of this Site, including all Material, and to prevent any unauthorized copying of the Materials. FOREST MASTER does not grant any express or implied right to you under any patents, designs, trademarks, copyrights or trade secret legislation. You acknowledge and agree that you will not, and nothing in these Terms gives you the right to, use FOREST MASTER trademarks, trade names, service marks, logos, domain names or other distinctive brand features other than as expressly stated in the FOREST MASTER’s Trade Mark List. Please note that any information, unsolicited suggestions, ideas or other submissions will be deemed not to be confidential and to be non-proprietary. By sending any information or material, except in a Patent Information Declaration as described in the FOREST MASTER Policy Regarding Consideration of Unsolicited Ideas, you grant FOREST MASTER an unrestricted, royalty-free, irrevocable and worldwide license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that FOREST MASTER is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. Software
Any software that may be available to download from this website (the “Software”) is the copyrighted work of FOREST MASTER and/or its suppliers. Use of the Software is governed by the terms of the end-user license agreement, if any, which accompanies or is included with the Software (”License Agreement”). Unless otherwise follows from the License Agreement the Software is made available for downloading solely for use by end-users. Any reproduction or redistribution of the Software not in accordance with the License Agreement may result in civil and criminal penalties. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, FOREST MASTER HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

For your convenience, the Site may include links to sites on the Internet that are owned, published and maintained by third parties. FOREST MASTER does not undertake to monitor or review such Third Party Site Content nor is FOREST MASTER responsible for the accuracy or reliability of any such third-party websites.

Limitation of liability
IN NO EVENT SHALL FOREST MASTER BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, CONTRACT, REVENUE, DATA, INFORMATION OR BUSINESS INTERRUPTION) RESULTING FROM, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE THIS SITE OR THE CONTENT OR OUT OF OR IN CONNECTION WITH THESE TERMS, EVEN IF FOREST MASTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Jurisdiction Statement
This Site is controlled, operated and administered by FOREST MASTER from its offices in the UK. FOREST MASTER makes no representation that materials at this Site are appropriate or available for use at other locations outside of the UK. Accessing the Site from territories where the contents of the Site are illegal is prohibited. If you access this Site from locations outside of the UK, you are responsible for compliance with all local laws. The laws of the United Kingdom shall govern this Agreement, without giving effect to its conflict of laws provisions. The Courts of England and Wales shall have exclusive jurisdiction in the first instance on any dispute arising from this Agreement.
Terms of Product Warranty
The purchased product carries a limited parts warranty from the date of purchase for the indicated time. Please keep proof of purchase as this will be required for any claim.
Should the product become defective, contact the store where it was purchased and either replacement parts will be issued, it will be repaired or it will be replaced free of charge.
In the unlikely event of a fault, the customer may be required to undertake basic fault finding with the aid of our technical support team.
NO RESPONSIBILITY IS ACCEPTED FOR INCORRECT USE OF THE PRODUCT. MODIFICATION OF THE PRODUCT (UNLESS AUTHORISED BY FOREST MASTER) WILL VOID THE WARRANTY.
The warranty does not cover:
- Any part that has become inoperative due to misuse, abuse, neglect, accident, improper maintenance, or alteration.
- The unit, if it has not been operated and/or maintained in accordance with the owner’s manual.
- Normal wear
- Routine maintenance items such as lubricants or blade sharpening.
- Normal deterioration of the exterior finish due to use or exposure.
- Commercial use for hire or rental.
Shipping charges:
Shipping charges for the delivery or collection of the unit, parts of the unit or attachments to the unit are the responsibility of the purchaser. The purchaser must pay transportation charges for any part submitted for replacement under this warranty unless such a return is requested by Forest Master.
International customers including EU states may be subject to import tariffs and taxes imposed by your own country on receipt of your goods.
Return and Collection:
When arranging the collection of your item for return, in any circumstance, you must ensure that the item is completely safe for travel. If you are returning an item that is equipped with a petrol engine, then the engine must be dry of all petrol (fuel) and engine oil. By agreeing to our collection, you are confirming and verifying that you have taken all precautionary measures to ensure the safe transit of the item.
Delivery Acceptance
Due to the substantial size and weight of Forest Master products, a customer or authorized representative must be present to receive and sign for the delivery. Delivery personnel are not permitted to leave items unattended. The initial delivery attempt will be made at no additional charge to the customer. Should the customer or authorized representative be unavailable at the time of delivery, subsequent delivery attempts may incur additional fees.
Delivery Scheduling Adjustments
Should a customer anticipate being unavailable to accept a scheduled delivery, they must contact Forest Master as soon as possible to explore alternative arrangements. Forest Master will endeavor to accommodate reasonable rescheduling requests to the best of its ability.
Price and Payment
a. The price of any Products will be as quoted on our site from time to time, except in cases of obvious error.
b. These prices include delivery costs, except in certain areas, which will be added to the total amount due as set out in our Delivery Information
c. Prices are liable to change at any time, but changes will not affect orders that have been placed, only new orders after the price change will be affected.
d. Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product’s correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
e. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after the order has been accepted if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing.
f. International customers including EU states may be subject to import tariffs and taxes imposed by your own country on receipt of your goods.
g. Pay in 3 eligibility is subject to status and approval. UK residents only. Pay in 3 is a form of credit, may not be suitable for everyone and use may affect your credit score. Late fees apply for missed payments. See product terms for more details.
